Terms of Service

These Terms govern access to and use of Fovio. Please read them before using the Service, purchasing a Guide or starting an in-app subscription.

1. Definitions

  • "App" means the Fovio mobile application for iOS and Android.
  • "Guides" means the digital PDF publications offered through the Website.
  • "Service" means the Website, the App, Guides and related Fovio content and features, as applicable.
  • "Website" means fovio-app.com and its pages.
  • "you" means the person accessing or using the Service or acquiring a Guide.
  • "we", "us" and "Fovio" mean the operator identified in section 2.

2. Contracting party and acceptance

These Terms form an agreement between you and BL17 Group Borys Lenartowicz. By accessing or using the Service, creating an account or acquiring a Guide, you agree to these Terms to the extent applicable to that activity. If you do not agree, do not use the Service.

3. Nature and limits of the Service

Fovio is a wellness and self-discovery service. It provides educational content, browser-based tests, episodes, a diary, situation analyses, personal observations and Guides intended to support reflection and self-understanding.

The Service is not therapy, medical care, psychological treatment or diagnosis. It does not replace a doctor, psychologist, psychotherapist or other qualified professional. Results describe possible tendencies and patterns, not health conditions. We do not guarantee any particular personal, psychological, relationship, financial or other outcome. You remain responsible for decisions made on the basis of the Service. Further limitations are stated in the Disclaimer.

4. Eligibility and accounts

You must be at least 16 years old to use the Service. If you have not reached the age of legal majority, you may enter a paid transaction only with permission from a parent or legal guardian where applicable law requires it. When you create an account, you must provide accurate information, keep authentication credentials confidential and promptly notify us of suspected unauthorised access. You are responsible for activity under your account to the extent permitted by law. Account deletion is available as described in the Privacy Policy.

5. Guide purchases

5.1 Product description and price

Each Guide is digital content supplied as a PDF without digital rights management. The description on the relevant Guide page states the complete content and scope of the purchase. The final price, including applicable VAT or other sales tax, is displayed before payment is submitted.

5.2 Paddle as merchant of record

Guide transactions are processed by Paddle.com as merchant of record and authorised reseller. You purchase the Guide from Paddle, while we license the Guide content to you under these Terms. Paddle operates the checkout, collects payment and applicable taxes, issues transaction documents and processes refunds. Paddle's Buyer Terms also apply to the transaction. The charge is shown under Paddle's name, rather than Fovio's name, on your payment statement.

5.3 Immediate delivery and 14-day refund

A Guide is made available immediately after payment. You may nevertheless request a full refund of a Guide for any reason within 14 days after the purchase, as set out in the Refund Policy. Any consent to immediate delivery given at checkout does not shorten this period. Your mandatory rights concerning faulty or non-conforming digital content remain unaffected.

5.4 Delivery and replacement access

The download is made available after the transaction and may also be delivered by email. If access is lost, contact support@fovio-app.com from the email address used for the transaction and provide the order number. Subject to verification, we will provide replacement access to the same Guide.

5.5 Refused or cancelled orders

We or Paddle may refuse or cancel an order where payment is not authorised, fraud or abuse is reasonably suspected, the displayed price is an obvious error, or the transaction breaches these Terms. If payment was collected for an order that is cancelled under this section, it will be refunded. We may refuse future sales to a person who has breached these Terms, subject to applicable law.

6. In-app subscriptions

  • Subscriptions are billed through the Apple App Store or Google Play account used to subscribe.
  • The subscription renews automatically for the stated billing period until auto-renewal is cancelled.
  • Cancel through the subscription settings of the relevant store at least 24 hours before the current billing period ends to avoid the next charge.
  • Deleting the App or your Fovio account does not by itself cancel a store subscription.
  • Refund requests for store transactions must be submitted under the rules of the store that processed the purchase, as explained in the Refund Policy.
  • If a subscription price changes, the relevant store will provide advance notice and request consent where applicable. You may cancel before the changed price takes effect.

7. AI-assisted features

The situation-analysis chat and certain personalisation features use artificial intelligence. You are interacting with an AI system, not a human professional. AI output may be incomplete, inaccurate or inappropriate to your circumstances. It must be treated as material for reflection and not as medical, psychological, legal, financial or other professional advice, or as the sole basis for an important decision.

8. Intellectual property and licence

The Service, including Guides, text, episodes, software, illustrations, graphics, branding and design, is owned by us or our licensors and is protected by intellectual-property law. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable and non-sublicensable licence to access and use the applicable Service content for your own non-commercial purposes.

Except where mandatory law permits otherwise, you must not:

  • share, upload, publish, distribute, sell, resell, sublicense or give another person access to a Guide or other paid content, in whole or in part;
  • copy or extract a substantial part of the Service, use scraping or automated collection, or circumvent access controls;
  • use Service content to create or improve a competing or derivative product, dataset or commercial service;
  • use Service content to train, fine-tune, evaluate or supply an artificial-intelligence or machine-learning system;
  • reverse engineer, decompile or interfere with the App except to the limited extent that applicable law expressly permits;
  • use the Service unlawfully, fraudulently or in a manner that infringes the rights or safety of another person.

Guide files may contain an order marker used to identify the transaction. A material breach of this section terminates the affected licence automatically. You must then stop using and delete all copies of the affected content. We may suspend access, refuse future sales and seek injunctive relief, damages or other remedies available by law.

9. Feedback

If you voluntarily submit feedback, suggestions or ideas, you grant us a worldwide, perpetual, irrevocable, royalty-free right to use, reproduce, modify and incorporate them into the Service without restriction or compensation. This does not transfer ownership of personal data contained in the submission, which remains subject to the Privacy Policy.

10. Availability and warranties

We may maintain, update, modify or discontinue features of the Service. We will not remove access to paid content contrary to mandatory law. To the fullest extent permitted by law, the Service is provided "as is" and "as available". We do not warrant uninterrupted availability, compatibility with every device, freedom from all errors, or that the Service will meet a particular expectation or produce a particular result.

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, consequential or special loss, loss of profit, revenue, opportunity or data, or loss arising from a decision made in reliance on Service content. To the fullest extent permitted by law, our aggregate liability arising from or relating to the Service is limited to the amount paid for the affected part of the Service during the 12 months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited. Nothing in these Terms restricts mandatory rights or remedies available to consumers under applicable law.

12. Suspension and termination

We may restrict, suspend or terminate access where you materially breach these Terms, misuse the Service, threaten its security or another person's rights, or where suspension is required by law or a platform provider. Where required by law, we will provide the reason and an opportunity to respond. You may stop using the Service at any time. Ending an account does not cancel an in-app subscription or create a refund right for a period already billed.

13. Complaints

Send complaints to support@fovio-app.com and include the email address associated with the order or account, the order number where applicable, and a description of the issue. We will respond within 14 days. This complaint process does not prevent you from using any remedy available under mandatory consumer law.

14. Governing law and jurisdiction

These Terms are governed by Polish law. If you are a consumer, this choice does not deprive you of the protection of mandatory provisions of the law of your country of habitual residence. You may bring proceedings in any court that has jurisdiction under applicable consumer law, including the competent courts of your country of residence where that right applies. These Terms and the related Fovio policies are drafted in English; translations are provided for convenience, and in case of discrepancy the English version prevails.

15. Changes to these Terms

We may amend these Terms to reflect changes to the Service, business operations, security requirements or law. The revision date identifies the current version. Material changes will be notified on the Website, in the App or by email before they take effect where required. If the law requires your consent to a change, the change will not bind you without that consent.

16. Severability and no waiver

If a provision of these Terms is held invalid or unenforceable, it will be applied to the maximum extent permitted and the remaining provisions will remain in effect. A failure or delay in enforcing a right does not waive that right.
